Looking at the subclause 41.2 of the NEC3 Professional Services Contract (PSC), it states the consultant corrects defects within a time which minimises the adverse effect on the employer and others. The clause also makes reference to the time required to the time required by this contract. Typically the contract data for other NEC3 contracts include a prescribed defect-correction period. We cannot see such provision within the PSC?

The defects date works in exactly the same way in the PSC as in the EEC but there is no defect-correction period in the PSC. Instead, the consultant I s required to correct each defect in accordance with that part of subclause 41.2 you have quoted. The reasoning is that this provision is considered to be more suitable for a contract for providing professional services.
